Consent to electronic receipt of client disclosures

By applying for an Account, you expressly acknowledge and agree to the following, under and in accordance with the laws of the Island of Guernsey:

(a) Use of Third Parties: The Company may delegate to third-party service providers the performance of administrative, compliance, technological, or other ancillary functions necessary to fulfil its obligations in respect of your Account. Such delegation shall be carried out in accordance with the Company’s regulatory obligations under the Regulated Activities (Bailiwick of Guernsey) Ordinance, 2017 and subject to appropriate contractual safeguards.

(b) Security and Method of Instruction: In compliance with the Company’s legal and regulatory obligations, the Company shall determine the method and level of authentication required to accept, validate, and execute instructions or requests made by you (the Account Owner) or your appointed Financial Advisor. This includes compliance with the Financial Services Commission (Bailiwick of Guernsey) Law, 1987 and any relevant rules or codes issued by the Guernsey Financial Services Commission ("GFSC").

(c) Valid Instruction Channels: Any instructions or requests from you or your Financial Advisor in relation to your Account shall only be recognised by the Company if:

  • submitted in writing to the Company at its registered office or a designated regional office; or

  • transmitted via the Company’s web-based platform (“Platform”) in accordance with the Account Terms & Conditions, Platform Terms of Use, and the Company’s Privacy Policy, all of which are governed by Guernsey law.

(d) Notifications: The Company may issue you Notifications from time to time, including transaction authorisations, compliance requests, declarations, or general disclosures. Such Notifications will be deemed validly given when delivered via the Platform and/or to your registered email address. These constitute legally binding communications under the Electronic Transactions (Guernsey) Law, 2000.

(e) Authorised Communication Channels: You acknowledge that the Company’s authorised email domains are limited to dominion-cs.com, dominion-funds.com, and dominion.co. Communications received from other domains shall not be treated as official or legally binding. Your Financial Advisor is not an employee, representative, or agent of the Company, and correspondence with them shall not constitute communication with or from the Company.

(f) Paper Copies of Electronic Records: In accordance with Guernsey’s electronic commerce legislation, you may at any time request a physical (paper) copy of any document that has been provided to you electronically. Documents issued through the Platform are available for download and printing from your Account's Documents section.

(g) Language Clause: The governing language of all contractual documentation, legal notices, and official communications is English. While translations may be provided for convenience, in the event of any discrepancy between a translated version and the original English version, the English version shall prevail and be legally binding.

(h) Document Verification: By approving a transaction on the Platform, you confirm that all accompanying documentation and identification is, to the best of your knowledge, accurate and authentic. Where such documentation has been submitted by your Financial Advisor, you confirm that they have personally verified the original documents and their copies. This declaration is made in accordance with your obligations under the Proceeds of Crime (Bailiwick of Guernsey) Law, 1999 and the Criminal Justice (Proceeds of Crime) (Financial Services Businesses) Regulations, 2007.

(i) Credential Security: You are solely responsible for the confidentiality and security of your Platform credentials. Any transactions validated through the Platform using your login credentials will be deemed duly authorised and binding upon you. The Company shall not be held liable for any losses or damages incurred as a result of unauthorised access, unless caused by proven gross negligence or willful misconduct on the part of the Company.

(j) Governing Law and Jurisdiction: These acknowledgements, and any dispute arising from or related to your use of the Account or Platform, shall be governed by and construed in accordance with the laws of the Island of Guernsey. The courts of Guernsey shall have exclusive jurisdiction to settle any such disputes, and you hereby submit to the personal jurisdiction of such courts for that purpose.
